Terms of Service — CoinForest

Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the coinforest.app website (“Site”), the downloadable CoinForest desktop application (“App”) and any related services (together, the “Service”), all operated by CoinForest Labs Ltd (“we”, “us”, “CoinForest”).

By downloading, installing or using the Service you accept these Terms and conclude an agreement with us. If you do not agree with any part of these Terms, do not download or use the Service.

If you use the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

Eligibility

You must be at least 18 years old and must not be barred from using our services. You may use the Service only in jurisdictions where doing so is lawful, including where earning, holding or transferring cryptocurrency is permitted. You are responsible for complying with all laws that apply to you.

The Software and your licence

The App is provided free of charge during the current beta. We grant you a personal, worldwide, non-exclusive, non-transferable and revocable licence to install and use the App on computers you own or control.

You may not copy the App except for routine backups, reverse engineer it except as permitted by applicable law, remove our branding, or rent, resell or redistribute it as your own product.

The App communicates with third-party faucet websites. The Service does not include those websites, and we do not operate or control them.

Acceptable use

You agree not to use the Service to break any law or any third party’s terms, to abuse faucet economies, to distribute malware or to attack our infrastructure.

You may run the App on multiple machines and with proxies, provided you comply with the terms of each third-party faucet and service it interacts with. Earnings obtained in breach of a faucet’s rules are your sole responsibility.

Third-party services

The App supports third-party faucet websites, micro-wallets and exchanges. We do not control them and are not responsible for their availability, rules or payout behaviour, or for any losses caused by them. Their terms may limit or prohibit automated claiming; it is your responsibility to check before running the App against a given service.

No financial advice; no earnings guarantee

Nothing on the Site or in the App is financial, investment, tax or legal advice. Cryptocurrencies are volatile and faucets may change or stop payouts at any time.

We do not guarantee any minimum or maximum earnings, uptime or uninterrupted faucet support. Any figures shown on the Site are illustrative.

Updates and availability

We may update the App, add or remove supported faucets and change features at any time. Some updates may be installed automatically. We may pause or discontinue any part of the Service and will announce material changes on the Site.

Intellectual property

The Site, the App, the CoinForest name and logo and all related materials are owned by CoinForest Labs Ltd and protected by intellectual property laws. These Terms grant you no rights in our trademarks or content except the licence in section 3.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service is compatible with every system configuration.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost tokens or lost data. Our total aggregate liability arising from the Service is limited to USD 50, or the amount you paid us for the Service in the previous 12 months if greater.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

Changes to these Terms

We may update these Terms from time to time. The current version is always available on the Site with its “Last updated” date. If a change is material, we will announce it on the Site. Continuing to use the Service after a change means you accept the new Terms.

Governing law and disputes

These Terms and any disputes arising from them are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of England and Wales have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.
